Article 1: Scope of Application
1. These terms apply to all services provided by the party A’s website (www.fizzabc.com, hereinafter referred to as "the Website").
2. These terms take effect from the moment party B first applies for the service and remain effective until the membership is canceled. Even if the membership is canceled, Article 9 shall remain effective.
Article 2: Definitions
1. Course: A complete learning program such as “Business English Course” or “Kid’s Box,” which may include multiple lessons.
2. Lesson: An individual session, such as a 25-minute teaching period.
Article 3: User Registration
1. Party B shall complete user registration according to the procedures specified by party A and provide true and accurate personal information, including name, phone, email, password, and other necessary details.
2. Upon registration, party B is deemed to agree to the following terms:
(1). Have read and understood the entirety of these terms;
(2). Keep registration information secure and bear any consequences due to negligence;
(3). Obtain consent from a legal guardian if under the age of 20;
(4). Register as an individual only; accounts cannot be transferred or shared;
(5). Ensure that the equipment and network environment meet party A’s requirements;
(6). Agree to display necessary personal information on the booking page for course arrangements.
3. After registration, if party A does not confirm payment, party B’s access to services may be restricted.
4. Even if a third party is authorized to register on behalf of party B, party B must comply with these terms.
Article 4: Fees and Payment
1. Party A charges service fees based on the pricing plan, referred to as “Course Credits Fees.”
2. Party B acquires course credits through top-ups, with 1 HKD = 0.5 course credits. Promotional offers may include additional bonus credits.
3. Party B bears any bank fees incurred during payment.
4. If party A cannot confirm party B’s payment, services may be suspended. Party A is not liable for any losses resulting from delayed payment.
5. Course credits acquired by party B must be used within one year from the top-up date. Unused credits after expiration will be void and are not refundable or extendable.
Article 5: Rules of Service Usage
1. Lessons consume course credits as per pricing. Credits are frozen upon booking and deducted upon lesson completion.
2. Each lesson lasts 25 minutes; bookings must be made between 15 days and 120 minutes before the lesson; cancellations require at least 120 minutes’ notice.
3. If lessons cannot proceed due to reasons not attributable to party B, course credits will be refunded; absence due to party B’s reasons will not be refunded.
4. Being more than 10 minutes late is considered absence; credits will be deducted, and the teacher may leave the classroom.
5. Customer support is available in both English and Chinese, with responses typically within two business days.
Article 6: Service Suspension or Termination
1. Party A is not liable for refunds or compensation if services are suspended due to force majeure or statutory holidays but will notify party B in advance.
Article 7: Refund Policy
1. Party B may request a refund after confirming payment:
(1). Bonus credits are not eligible for refunds;
(2). Refund amount within 5 days of payment = (remaining course credits - bonus credits) x exchange rate;
(3). For requests made more than 5 days after payment, a 20% cancellation fee will apply, with a minimum fee of 250 HKD.
(4). Refunds will be completed by the end of the following month, and party B bears the related bank fees.
Article 8: Information Update
1. Party B must update registration information promptly. Consequences arising from failure to update information are borne by party B.
Article 9: Prohibited Conduct
1. Party B shall not engage in the following conduct. Party A reserves the right to suspend services and pursue legal responsibility:
(1). Transferring, selling, or sharing accounts or services;
(2). Recording, copying, or distributing course content without authorization;
(3). Attempting to crack, tamper with, or interfere with party A’s platform systems, content, or functionalities;
(4). Posting or spreading illegal or extremist political or religious statements or behaviors;
(5). Posting or spreading insulting or defamatory remarks about teachers or other users;
(6). Damaging party A’s reputation and service order in any way;
(7). Soliciting personal information from teachers, including but not limited to contact details (phone, WeChat, email, address, etc.);
(8). Inducing teachers to bypass party A to provide private teaching services;
(9). Recruiting teachers to competitors of party A;
(10). Engaging in other illegal activities or infringing on user or party A’s rights.
2. Party A may take one or more actions against violators, including:
(1). Suspension or termination of services;
(2). Forfeiture of unused course credits;
(3). Prohibition from future registrations;
(4). Legal actions and damage claims.
Article 10: Information Disclosure
1. Party A may disclose party B’s information if required by law or service necessity. Party B is responsible for keeping personal information confidential.
Article 11: Amendments
1. Party A reserves the right to amend these terms. Amendments will be announced on the official website, and continued use of services after the effective date is deemed as agreement to the changes.
